Instead of ping unconstitutional laws like Proposition 8, why not just eliminate the 1st Amendment?

Prop 8 was a constitutional amendment and though our Attorney Gen. seems to think the constitution is unconstitutional, I find the charge a bit strange. Had it failed though, I'm sure the 1st amendment would have been eliminated (okay hampered) for Christians who wanted to explain certain parts of the Bible.
